Article 1: Fields of Application and Modification of the General Conditions of Sale 

These general conditions of sale apply to all orders placed on the website http://www.makear.com  reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order. 

Article 2: Availability of products 
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.
Upon receipt of your order, we check the availability of the product(s) ordered.
In the event of unavailability, we undertake within 30 days from the validation of the order either to deliver the ordered product to you, or to offer you a similar product at a similar price, or to reimburse you if the amount of the product is greater than €50 or in the form of a voucher if the amount of the product is less than €50. In the case of the issue of a purchase voucher, you can, on simple request to our Customer Service, request the cancellation of this one, by telephone or by simple mail (however, for more security, we recommend sending a letter with acknowledgment of receipt) to the following address:

In order to process your request correctly, please remind us of your order number and your full contact details. If one of the products in your order is out of stock: We will ship the rest of your order. 

Article 3: Validation of orders and electronic signature (law of March 13, 2000 on electronic signature) 
Any purchase order signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be called into question within the limits provided for in these general conditions of sale. 
The "double click" associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature.

This electronic signature has value between the parties in the same way as a handwritten signature. 

Article 4: Prices - Rates
The prices listed on the site are prices including VAT in euros.
The prices indicated do not include order processing, transport and delivery costs provided that they take place in the geographical areas provided for below. 

4.1 - General 
capricebeaute.com reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated to you at the time of your order. 

Article 5: Terms of Payment and Security 

Terms of Payment 
You can make the payment:

Your order is then reserved for 7 days. Beyond this period, without receipt of your transfer, it will be canceled.

Retention of title clause 
The products remain the property of Makear.com until full payment of the order.
However, from the receipt of the order by the customer, the risks of the delivered goods are transferred to the customer. 

Default of Payment 
Makear.com reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. . 

6.1 - Terms 
General 
The products are delivered to the delivery address that you indicated to us during the ordering process. 
For parcel tracking reasons, it is impossible for us to deliver orders to the bases or other premises of the Armed Forces.

 

6.2 - Shipping times 
All lead times announced are calculated in working days. 
The times indicated are average times and correspond to the times for processing, preparing and shipping your order (out of warehouse).
They run as soon as the order is validated* . 
To this time, you must add the delivery time of the carrier (Poste-DPD // Carrier). 
Any item available in stock is dispatched within 48 to 96 hours. 
In all other cases, availability may vary between 3 and 30 days depending on the type of products ordered. 

6.3 - Delivery times
Terms of delivery 
If the products need to be returned to us, they must be the subject of a return request to our Customer Service (see Article 9):  
within 7 days of delivery for a withdrawal, within 15 days for defects or if you have not received the correct reference after the customer has demonstrated and verified the hidden defect. 
Any complaint made outside this period cannot be accepted.
For a withdrawal or if you have not received the correct reference, the return of the product can only be accepted for products in their original state (packaging, accessories, instructions) Except varnish due to hygiene safety.  

Article 7: Responsibilities 
Makear.com cannot be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure

The choice and purchase of a product or service are placed under the sole responsibility of the customer.

Article 8: Processing of packages not delivered by the service provider 
These are packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage, spoliation… 


8.1 - Returns under the pattern NPAI

These are the packages returned by the service provider responsible for delivery under the mention: Does not live at the indicated address. 
Processing a return NPAI 
After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wishes,
we will offer you to reship the product initially ordered or an exchange product with equivalent characteristics, the costs being your responsibility.

8.2– Returns under the reason “refused” 
You refused your package at the time of delivery because it showed obvious traces of opening and/or shocks 
After receipt and acceptance of your package by our services, a reshipment will be planned with you.

Article 9: Right of return 
9.1 - Return procedure and general conditions 
For the purpose of identification and therefore optimal processing of returns, any product requiring to be returned must be the subject of a return request to our services, under penalty of being refused. The time allowed to you to contact your customer service depends on the reason for the return; please refer to points 9-2 and following of the GCS. 
Upon receipt of the agreement, you have 15 days to return the product to us. After this period, your return will be refused. Please note that any package not shipped by us is not our responsibility. Only the sender of the parcel is able to launch an investigation with the postal services. 
In order to properly process your request, please remind us of your order number and your full contact details. 
Note: Upon receipt, our services will check the conformity of the returned product and the reason for return. If the returned product is not in conformity, it will be refused by our services and will be sent back to you, at your expense. If your return is made for the wrong reason, your product may be refused and therefore sent back to you at your expense. The return pattern may especially be reclassified. From then on, you will be informed by e-mail and the processing of your return will therefore depend on the new reason. 
You will find below the procedure to follow regarding the return of your package. Please respect this procedure so that our services can process your request. Otherwise, your package will be refused: 
Carefully prepare and protect your package: Please carefully protect the original packaging of your package and above all do not write anything on it.   In the event of a withdrawal, if the product has a protective label on the packaging, please do not tear it or try to open the packaging (possible refusal of the return, consult our T&Cs). Please return the entire original package. Include with your package a letter with your exact contact details, and recalling your order number with the reason for return. 
Reserve: 
Makear.com reserves the right to refuse the package, refund or exchange, if the return conditions mentioned above are not respected. Upon receipt of this product, we will process your return in order to respond to your wishes as quickly as possible. 

9.2- Returns for withdrawal 
Terms of return 
In accordance with article L.121-20 and following of the Consumer Code, you have a period of 14 working days from the date of delivery of your order, to return any item that does not suit you, in its packaging. original and in good condition, fit for re-marketing and request an exchange or refund without penalty, except for return costs. You therefore have 14 days to inform us that you wish to withdraw. 
ATTENTION: No withdrawal will be accepted if the returned product is unsuitable for re-sale. Therefore: 
- The product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged, unmarked. 
Otherwise, the product will be returned to you, at your expense. 
In order to properly process your request, please remind us of your order number and your full contact details.  
Specific conditions for exercising the right of withdrawal 
Returns will not be accepted if the return request is out of time and/or if the original packaging has been uncovered, unsealed, opened, torn, marked… 
Sale and destocked products will not be taken back or exchanged; except in the case of hidden defects.
